The President of Ukraine signed a moratorium on business checks before the end of 2017.
The Business Restriction Law prohibits the majority of supervisory authorities from conducting routine inspections in 2017, leaving, nevertheless, the possibility of unscheduled inspections in several cases
President Petro Poroshenko signed the law passed by the Verkhovna Rada, which provides for the extension of the moratorium on conducting business audits until December 31, 2017.
According to the document, until 31 December 2017 regulatory authorities may conduct unscheduled inspections only. At the same time, the law provides for four reasons for conducting an unscheduled audit: on the basis of an enterprise’s application for an audit at its own discretion, by a court decision, because of an accident at the enterprise, and also on the basis of an individual’s application for violation of his legal rights by a business entity. Such treatment should be considered and agreed with the State Regulatory Service.
Nevertheless, the moratorium does not apply to a number of regulatory bodies – food safety and quality checks by the State Veterinary and Phytosanitary Service of Ukraine, the National Commission for Energy and Public Services, the National Commission on Securities and the Stock Market, the State Service for Food Safety and Consumer Protection , The State Fiscal Service, the State Financial Inspectorate, the State Service for Export Control, the State Inspectorate for Nuclear Regulation, the State Council rstvennoy Aviation Service, the National Bank and the Antimonopoly Committee.
This law comes into force from the day after publication. The Cabinet is obliged within six months to develop and approve a strategy and program for reforming the state supervision system, in particular with regard to reviewing the state’s supervisory functions, reducing the number of state supervision bodies and the number of their employees.
And the State Regulatory Service within two weeks should approve the form and procedure for providing and conducting an unscheduled business audit.
